We collect personal information including: name, phone, email, identification documents, financial and employment details (for tenancy applications), property preferences, communications, and other information necessary to provide our services.

How we collect: open home sign-ins, website enquiries, phone/email, and third-party platforms (realestate.com.au, Domain.com.au, online tenancy applications).

Sales-specific collection:

Prospective/current vendors: to identify you and the property and act as your sales agent

Prospective/current purchasers: when attending inspections or making enquiries

Other enquiries related to properties or services

Note: Failing to provide this information may prevent us from offering our services, and property owners may deny access if required information is not provided.

Agents, owners, insurers, contractors, legal/financial advisors

Public registers (e.g., NSW Land & Property Information)

Publicly available information, valuers, and related service providers

Other service providers authorised to supply personal information

 

Legal obligations: Certain laws, such as the Property, Stock and Business Agents Act 2002 (NSW), may require collection and disclosure of personal information.

 

2. In-Person Collection Transparency

When collecting personal information in person at inspections or open homes, we ensure you are informed about:

Why it is collected: to manage property inspections, enquiries, tenancy or sales processes

How and where it is stored: securely in our offices, CRM systems, and approved third-party platforms, including cloud storage with potential overseas storage in USA, Europe, Asia (Philippines, India), and New Zealand

How long it is retained: tenancy applications 60 days, transaction documents 3 years, essential information for successful applications

Principle: information is kept only as long as necessary

 

3. Use and Disclosure

Sales-related purposes:

Identify/verify prospective or actual vendors

Advertise, market, and promote properties

Negotiate/manage sales, including non-legal assistance with contracts and statements of account

Liaise with vendors, purchasers, agents, contractors, legal/financial advisors

Ensure safety/security during inspections and auctions

Comply with applicable law and confirm GST registration

Direct marketing about other properties/services unless you opt out

 

General purposes:

Provide statistical info to the Real Estate Institute of NSW

Run our business efficiently and perform administrative/operational tasks

Comply with dispute resolution or legal processes

Act on behalf of clients under agency agreements

Update records and contact details

Operate controlled money accounts

Provide personal information to potential acquirers of our business (and their advisors)

Overseas disclosure: Some information may be stored in cloud or networked storage accessed from other countries. We take reasonable steps to ensure compliance with the Act.

 

5. Retention of Information

Tenancy applications (realestate.com.au) retained 60 days; unsuccessful applications destroyed

Successful applications retain only essential information (contact/licence details)

Transaction documents retained for 3 years and then regularly and securely destroyed

Information is kept only as long as necessary

 

6. Anonymity & Pseudonymity

We cannot always deal with people who wish to remain anonymous, particularly for tenants, vendors, or purchasers, due to identification, security, and owner concerns. We may provide general information to unidentified individuals when possible.

 

7. Information Security

We take reasonable steps to protect personal and sensitive information from misuse, loss, unauthorised access, modification, or disclosure.
